Service Agreement

This agreement is valid for all services provided through our website. Real persons or legal entities who wish to place an order must read the entire agreement beforehand. This agreement consists of the terms and conditions of services provided by Cadde Creative Information Technologies Trade Limited Company (“Cadde Creative”). If you do not accept this agreement, you must immediately stop the ordering process. All customers who place an order or make a payment shall be deemed to have accepted this agreement. Our agreements are presented to you openly both at the time of registration and through our website.

1. Service Provider and Parties

1.1: This agreement is between Cadde Creative Information Technologies Trade Limited Company (hereinafter “Cadde Creative”), which provides the services specified in the services section (hereinafter “Services”), and the individual or institution specified in the details section of the new customer registration (hereinafter “Customer”), regarding the use of the internet site operated under Cadde Creative’s domain name (hereinafter “Site”), and the purchase, accounting, and invoicing of services through this site, subject to the terms and conditions outlined below.
1.2: The parties declare, accept, and undertake that the information written in this agreement is accurate.

2. Subject of the Agreement

2.1: This agreement regulates the sections that the Customer is permitted or not permitted to perform through the Site, based on the information provided during registration, messages sent, or orders placed, and the fees that the Customer shall pay to Cadde Creative in exchange for the selected services.
2.2: Membership information consists of the information provided by the Customer during registration. As this information will be taken as a basis for transactions, it is assumed to be accurate and complete, and transactions are carried out accordingly.

3. Responsibilities of the Agreement

3.1: Cadde Creative Internet Services shall provide the services requested by the Customer in the order submitted. With the confirmation of the order, Cadde Creative accepts the payment and undertakes to provide the service specified in the order.
3.2: The payment method and VAT differences will be indicated with the total amount at the time of order, according to the Customer’s monthly or annual payment preference. If “VAT Included” is stated on the product’s sales page, the system will complete the order without calculating VAT.
3.3: Upon acceptance and approval of the order, Cadde Creative shall provide the Customer with the relevant control panel, FTP, SQL, and e-mail usernames and passwords, and the service shall commence. The responsibility for these accounts and passwords belongs solely to the Customer.
3.4: The Customer undertakes to comply with all declarations and warnings provided by Cadde Creative within the scope of the services. The Customer accepts and undertakes to comply with all notifications made by Cadde Creative. Free and unlimited services provided within hosting cannot be distributed or sold to third parties.
3.5: The Customer undertakes not to access files or programs without authorization and accepts liability for any damages caused by such actions.
3.6: The Customer accepts that all applicable taxes, fees, and charges during or after the contract term are their responsibility.
3.7: The Customer is fully responsible for all files, documents, and programs hosted within the service, as well as website and mail services. Cadde Creative bears no responsibility for the legality of the content, and any legal or criminal liability belongs solely to the Customer. Cadde Creative does not review, verify, endorse, or assume responsibility for user-created content but reserves the right to terminate accounts without notice if deemed harmful or unlawful.
3.8: Cadde Creative is not responsible for misuse, data content, or any damages arising from e-mails. Data backup is the responsibility of the Customer, though Cadde Creative performs regular backups. However, Cadde Creative is not liable for interruptions or data loss.
3.9: Domain name registrations paid for by the Customer are processed by Cadde Creative, but ownership belongs to the Customer. Cadde Creative shall carry out domain-related requests as instructed by the Customer.
3.10: If the Customer engages in defamation or negative campaigns against the company, Cadde Creative reserves the right to terminate the account without liability.
3.11: The Customer is responsible for paying shipping fees for invoices requested by mail. If returned, the shipping cost will be invoiced. Non-payment may result in suspension of services until settled.
3.12: The Customer cannot hold Cadde Creative responsible for third-party software-related issues. Server services are provided on an unmanaged basis.
3.13: Services are delivered within 48 hours after payment unless otherwise stated. If delivery is not made within this period, the Customer may request a refund.
3.14: Cadde Creative may use SMS or e-mail for announcements. Customers who do not wish to receive such communications must notify Cadde Creative through a support request.

4. Service Delivery Period

4.1: The obligations of both parties begin once the order and payment are received by Cadde Creative online.
4.2: The duration of the contract is the payment period selected during the order.
4.3: Unless notified 10 business days before expiration, the contract automatically renews under the same terms.
4.4: Hosting and reseller accounts are activated automatically after payment confirmation. VDS servers are delivered within 24 hours and dedicated servers within 48 hours.

5. Payment Details

5.1: Fees are those stated at the time of order. VAT is added if not included.
5.2: Cadde Creative reserves the right to change prices without prior notice.
5.3: If payment is in foreign currency, it is converted at the Central Bank’s exchange rate on the invoice date.
5.4: Payments must be made within 5 business days of the invoice date.
5.5: In case of late payment, Cadde Creative may issue an exchange rate difference invoice or apply a 25% monthly late fee.
5.6: Services may be suspended until payment is completed.
5.7: Domain names, SSL certificates, and server services are non-refundable.

6. Suspension of Services

6.1: Cadde Creative reserves the right to suspend services, including e-mail, web, and FTP accounts, due to payment issues or violations.
6.2: Suspended services will block access and return incoming e-mails.
6.3: Maximum CPU/RAM usage per account is 20%. Accounts exceeding this limit may be suspended. Cron jobs under 60 minutes are prohibited. Hosting accounts may not be used for file archiving.
6.4: Content violating laws (e.g., spam, hacking, warez, adult content, copyrighted material) is strictly prohibited.
6.5: Customers are responsible for their software security.
6.6: If invoices are not paid within 1–3 days of due date, services may be suspended.
6.7: DDoS attacks are prohibited. Detection results in immediate termination.
6.8: Services may not be used to host restricted content (e.g., pornography, spam, phishing, illegal downloads, gambling, hate speech, hacking tools, etc.).

7. Termination of Agreement

7.1: If the Customer breaches any terms, Cadde Creative reserves the right to terminate without notice. No refund is issued, and the Customer must pay a penalty equal to five times the contract fee.
7.2: Customers may terminate the contract with 10 days’ written notice before expiration. Early termination requires paying half of the remaining fees.

8. Communication and Notification

8.1: Parties accept their registered addresses as legal domicile.
8.2: Notices sent to these addresses are considered delivered even if not received.
8.3: Notifications via e-mail are legally valid after 1 day of sending.

9. Payment Disputes

9.1: If payment is not made within 7 days, the Customer is in default. Cadde Creative may charge 25% monthly interest.
9.2: In case of legal proceedings, the Customer agrees to pay late interest, penalties, attorney fees, and legal expenses.
9.3: Cadde Creative may seek precautionary measures without providing collateral.
9.4: Services may be deleted irreversibly if payment is not made within 1 week.

10. Hosting Service Terms

Max CPU usage: 25%.
No mass mailing or archiving.
Customers must keep their own backups.
Hosting accounts violating these rules may be suspended without notice.

11. VDS / Dedicated / Game Server Terms

Max CPU usage: 50%.
Network usage may not exceed 100 Mbit/s.
Abuse/SPAM issues may lead to suspension.
Cadde Creative is not responsible for software setup/maintenance unless a Support Package is purchased.
Backups are the Customer’s responsibility.

12. Refund Policy

Refunds are subject to VAT and bank fees.
Preloaded credits or renewals are non-refundable.
Only Turkey-based hosting services are refundable within 72 hours.
Domains, servers, licenses, and promotional products are non-refundable.
Refund requests may take 5–30 days.

13. Hardware Failures

Servers may fail despite precautions. Replacement parts are supplied by data centers.
Cadde Creative is not liable for delays.
RAID or software errors may result in irrecoverable data loss.

14. Jurisdiction

14.1: This agreement consists of 14 articles and is deemed signed electronically upon order submission.
14.2: Annual contracts may incur additional charges due to inflation.
14.3: Any disputes arising from this agreement shall be resolved exclusively by Istanbul Courts and Enforcement Offices.
